May 2006 - DUI SOURCE CODE SEMINAR

This month, Michael Kessler taught a seminar on DUI source code litigation for the Georgia Bar Department of Continuing Legal Education.

 DUI source code is the software that tells the breath alcohol testing machine (e.g., the Intoxilyzer 8000) how to evaluate the breath sample and report its estimate of the subject's breath alcohol level. At present there is some dispute as to the devices' accuracy and fairness. This dispute has resulted in ongoing litigation to determine whether defense attorneys should be allowed to review the source code, and whether the manufacturors' work should be subject to the scrutiny of the public.

 Mr. Kessler is currently working on an article on the litigation for a prominent Florida law magazine. The article has not yet been accepted for publication. Mr. Kessler has also been invited to lecture at a seminar in Lansing, Michigan in October on the same subject. Mr. Kessler's lecture this weekend was held in Atlanta, GA.
